PRIVACY POLICY AND PERSONAL DATA PROTECTION DAf S.A.


DAf S.A. announces to all persons accessing its platforms, web pages, digital services, payment portals or mobile applications of the following Privacy and Personal Data Protection Policy, in order to inform users of the platforms, pages, services or applications on the processing of personal data that are made during navigation, payment, execution of the service or download, as the case may be.

DAf S.A. (“DAf”, “the Agency” or “we”) takes privacy and data protection very seriously, therefore all processing of personal data is carried out in the manner and conditions established by the highest international standards such as ISO/IEC 27001 and ISO/IEC 27002. In addition we respect the legal framework or applicable legislation as appropriate, among which we include Chilean Law No. 19. 628 on Privacy Protection, and other foreign laws such as the European Data Protection Regulation (GPDR or RGPD), as well as the California Privacy Rights Act (CPRA) and the Data Protection Act of 2018 of the United Kingdom (DPA of 2018), all laws that ensure the confidentiality of personal data of those who register, visit or contract DAf services through its navigation or the form(s) established for that purpose. DAf S.A. will only process personal data with respect to those personal data that have been voluntarily submitted by users.

In accordance with the provisions of Article 19 No. 4 of the Political Constitution of the Republic and the relevant provisions of Law No. 19,628 on the protection of privacy and its subsequent amendments, and under the terms, scope and conditions expressed below:

Unless we link to a different policy or state otherwise, this Privacy Policy will apply when you visit or use DAf S.A.’s website, mobile applications, APIs, other platforms or related services (the “Services”).

By using the Services, you agree to the terms of this Privacy and Personal Data Protection Policy. You should not use the Services if you do not agree to this Privacy Policy or any other agreement governing your use of the Services.

This policy is intended to ensure the appropriate use of the information collected through visits to this site and its contents.

I. DATA COLLECTED

DAf S.A. collects data from subscribers, users, customers and/or visitors who make use of its services, through two mechanisms:

AUTOMATIC: These are those computer processes carried out to generate records of the activities of website visitors and whose purpose is to establish patterns of activity, navigation and audience, which do not necessarily involve the personal identification of those subscribers, users and/or visitors who access our services. DAf reserves the right to use such general information, in order to establish criteria to improve the services or contents of the system, which is always dissociated from individuals.

MANUAL: These are formal and express requests for information to customers, subscribers, users and/or visitors of our platforms that occasionally involve the collection of personal data. DAf S.A. collects this data in order to deliver its services and improve the quality of information. We collect certain data from the user directly, such as that entered by the user. We also collect some data automatically, such as information about the user’s device, services with which the user interacts or the period of time for which the user is using our services.

II. DATA PROCESSING

With regard to the delivery of information collected through the automatic mechanisms mentioned above, and that do not contain personal identification of subscribers, users and / or visitors to the page, this may be used to obtain information on patterns of activity, navigation, audience and general characterization of this system.
Regarding the personal data of users, collected through manual mechanisms or other means, these will be used in order to provide our services and improve their quality, with strict adherence to national and international law and the international standards previously mentioned.

By accepting this Privacy Policy, you also authorize the Agency to:

Use your personal data for the purpose for which they were provided, as the case may be. To use the statistical information gleaned from the personal data of its users, when from such data it is not possible to individually identify the owners (dissociated or statistical data), in accordance with the Law.

Apart from the authorizations established above, DAf will maintain the due confidentiality of the personal data and will not transfer them to third parties, except when they must be delivered by reason of a legal mandate or an order issued by the Courts of Justice or other competent authority that so requires.

III. OWNERSHIP OF THE WEBSITE, ASSOCIATED SITES, APPLICATIONS.

lV. DATA COLLECTED AND PURPOSES OF PROCESSING

When visitors access the Service, DAf collects the IP address and other data relating to the connection and its origin. The IP address is a code that identifies the user’s Internet connection at a specific time.

Only the user’s Internet access provider can identify the subscriber who was assigned an IP address at a particular time. By the very nature of the server that supports the Service, the user’s IP address is automatically recorded along with the date and time of access.
DAf S.A. will process the data collected in its forms that users provide in order to manage the query, service or communication.

V. LEGAL GROUNDS FOR PROCESSING

The consent of the user expressed through the sending of their data through the form established for this purpose, together with the need for treatment for the maintenance or fulfillment of a contractual relationship, are the bases that validate the processing of personal data.

VI. USERS’ RIGHTS REGARDING DATA PROTECTION.

VII. SECURITY MEASURES

DAf S.A. has adopted all the necessary security measures to ensure the integrity, security and confidentiality of the personal data stored in its systems, in accordance with the provisions of current legislation on data protection, recognizing and appreciating the importance of the responsible use of this information.

VIII. PROHIBITED USE OF DAf S.A.’s SERVICES AND DATA

  1. You may not access or use, or attempt to access or use, the Services to take any action that may harm us or any third party. You may not use the Services in violation of applicable laws, including export controls and sanctions, or in violation of our or any third party’s intellectual property or other legal or proprietary rights. You further agree that you will not attempt (or encourage or support any other person’s attempt) to circumvent, reverse engineer, decrypt or otherwise alter or interfere with the Services, or any content on the Services, or make any unauthorized use of the Services.
  2. Without the prior written consent of DAf S.A., you shall not:
    1. access any portion of the Services, Content, data or information for which you do not have permission or authorization or for which DAf S.A. has revoked your access;
    2. use robots, bots, scripts, services, software or any manual or automatic device, tool or process designed to search for and obtain Content, data or information from the Services, or collect or access Content, data or information from the Services by automated means;
    3. use the Content for the development of any software program, model, algorithm or generative AI tool, including, without limitation, training or use of the Content in connection with the development or operation of a machine learning or artificial intelligence (AI) (including any use of the Content for training, fine tuning or grounding of the machine learning or AI system or as part of the generation of augmented recall).
    4. use manual or automated services, software or devices, tools or processes designed to circumvent any restrictions, conditions or technological measures that control access to the Services in any way, including overriding any security features or circumventing or bypassing access controls or limits on use of the Services;
    5. cache or archive Content (except for the use of spiders by a public search engine to create search indexes solely for the inclusion of links and short snippets of Content, not synthesized by AI, in search results);
    6. take any action that imposes an unreasonable or disproportionately large load on our network or infrastructure;
    7. do anything that may disable, damage or change the operation or appearance of the Services, including the display of advertising; and
    8. engage in text and data mining activities under Article 4 of the EU Directive on Copyright in the Digital Single Market.
  3. Engaging in prohibited use of the Services may result in civil, criminal and/or administrative penalties, fines or sanctions against the User and those assisting the User.
